Article 1 – Definitions

In these General Terms and Conditions, the following definitions apply:

Reflection period: the statutory period within which the consumer may exercise the right of withdrawal.

Consumer: the natural person who does not act for purposes related to trade, business, craft or profession.

Day: calendar day.

Durable medium: any means that enables information to be stored in a way accessible for future consultation and unchanged reproduction.

Right of withdrawal: the statutory right of the consumer to dissolve a distance contract within 14 days.

Entrepreneur: Skwimey’s, offering products via a webshop.

Distance contract: an agreement concluded exclusively through distance communication.

Products:

• handmade slime

• Taba squishies

• sensory toys and compounds

• blind boxes

• POP MART items

• vinyl and designer collectible figures

• plush products

• accessories and related merchandise

Blind box: a sealed collectible product where the specific figure or variant is unknown until the packaging is opened.

Collectible item: a limited-edition or series-based figure primarily intended for collection rather than play.

Seal: a factory, hygiene, or authenticity seal intended to prevent tampering and ensure product integrity.

Article 3 – Applicability

1. These General Terms and Conditions apply to every offer and every distance contract concluded between the entrepreneur and the consumer.

2. The terms are made available electronically before purchase and can be stored on a durable medium.

3. If any provision is invalid or unenforceable, the remaining provisions remain fully applicable.

4. Situations not explicitly regulated shall be assessed in the spirit of these terms.

Article 4 – The Offer

1. Skwimey’s sells slime, sensory products, squishies, blind boxes, plush products, and collectible figures.

2. All product descriptions are accurate to the best of the entrepreneur’s knowledge.

3. Handmade products may show minor variations in colour, texture, scent, or decoration and this does not constitute a defect.

4. Blind boxes are sold sealed and random; the specific figure is not guaranteed.

5. Images are illustrative; colours and details may vary depending on screen settings.

6. Obvious mistakes or errors do not bind the entrepreneur.

Article 5 – The Agreement

1. The agreement is concluded when the consumer accepts the offer and completes payment.

2. The entrepreneur confirms receipt electronically.

3. Orders may be refused or cancelled in cases of suspected fraud, incorrect information, or payment issues.

Article 6 – Right of Withdrawal

1. The consumer has the right to withdraw from the agreement within 14 days, starting the day after receipt of the product.

2. During the reflection period, the consumer must handle the product and packaging with care.

3. Products may only be inspected as would be permitted in a physical store.

Inspection does NOT include:

• opening sealed packaging

• breaking factory, hygiene, or authenticity seals

• removing internal packaging

• scanning or removing internal QR codes

• playing with, displaying, kneading, stretching, or using the product

For products sold without sealed packaging, such as plush products, inspection is limited to visual inspection and light tactile inspection only. Use beyond this is considered use beyond inspection.

Article 7 – Costs in Case of Withdrawal

1. If the consumer exercises the right of withdrawal correctly, return shipping costs are borne by the consumer unless stated otherwise.

2. Refunds will be issued within 14 days after receipt and inspection of the returned product.

3. Refunds are made using the original payment method unless otherwise agreed.

Article 8 – Exclusion and Limitation of the Right of Withdrawal

8.1 Hygiene-Sensitive Products

The right of withdrawal is excluded for hygiene-sensitive products once opened or used, including:

• slime

• putty

• sensory compounds

• Taba squishies

Once opened, these products cannot be returned due to hygiene and safety reasons.

8.2 Blind Boxes

1. Blind boxes are sold as sealed random products.

2. Opening a blind box confirms acceptance of the random nature of the product.

3. Opened blind boxes cannot be returned or exchanged, regardless of condition.

Any blind box showing signs of opening, tampering, resealing, glue residue, tape, heat sealing, reconstructed seals, or altered packaging is considered opened and is excluded from return, even if resealed carefully.

8.3 Collectible Figures with Authenticity Features

Collectible figures containing factory seals, internal packaging, authentication labels, or QR codes cannot be returned once opened. Any disturbance voids return eligibility, as authenticity can no longer be guaranteed.

8.4 Plush Products Without Sealed Packaging

1. Plush products sold without sealed or boxed packaging are subject to the statutory right of withdrawal.

2. Returns are accepted only if the plush:

   • is unused

   • is clean and free from odours

   • has all original tags attached

   • shows no signs of wear, washing, damage, or alteration

3. If use beyond inspection or hygiene issues are detected, the entrepreneur may refuse the return or apply a value reduction in accordance with Dutch law.

Article 9 – The Price

1. All prices are stated in euros (€) and include VAT.

2. Shipping costs are excluded unless stated otherwise.

3. Price changes due to VAT adjustments are permitted.

Article 10 – Conformity, Authenticity and Warranty

10.1 Authenticity of Collectible Products

1. Skwimey’s sells authentic collectible products which are purchased by the entrepreneur and resold.

2. Products are sourced from authorised retailers, official brand stores, distributors, or trusted secondary market sellers.

3. Skwimey’s is not the manufacturer and is not affiliated with or endorsed by POP MART or other brands unless explicitly stated.

4. All collectible items are checked prior to shipment for authenticity and condition.

5. Many POP MART products include a manufacturer-provided QR code inside the packaging which allows consumers to verify authenticity via the brand’s official verification system.

6. Removal or tampering with seals, QR codes, or internal packaging voids return eligibility.

10.2 Anti-Swap & Fraud Prevention

1. All returned products are inspected upon receipt.

2. Returns will be refused if items are swapped, altered, incomplete, resealed, or show signs of use or manipulation.

3. Packaging details, batch codes, and condition may be recorded prior to shipment.

4. Fraudulent return attempts may be refused and reported.

10.3 Warranty Limitations

Warranty does not apply to normal wear, misuse, display damage, modification, improper storage, or value loss due to opening sealed products. Minor variations are not defects.

Article 11 – Delivery and Execution

1. Orders are shipped within 30 days unless otherwise agreed.

2. Delivery is made to the address provided by the consumer.

3. Risk transfers to the consumer upon delivery.

Article 12 – Duration Transactions

Long-term or subscription agreements apply only if explicitly offered and agreed upon.

Article 13 – Payment

1. Payment must be completed during checkout.

2. Incorrect payment details must be reported without delay.

3. Reasonable collection costs may be charged within legal limits.

Article 14 – Complaints Procedure

1. Complaints must be submitted within 2 months after discovery.

2. Complaints are answered within 14 days.

3. If unresolved, disputes may be submitted via the European ODR platform.

Article 15 – Disputes

Dutch law applies exclusively.
The Vienna Sales Convention does not apply.

Article 16 – Additional or Deviating Provisions

Additional provisions may not disadvantage the consumer and must be recorded on a durable medium.
